This page describes the website managing procedures referred to users’ personal data treatment.

OMCN S.p.A., whose registered office is in Via Divisione Tridentina, 23, 24020 Villa di Serio (BG), Italia; P.IVA 01905830160 (hereinafter referred to as “Owner”), as treatment administrator, informs you, in accordance with UE n. 2016/679 regulation (hereinafter referred to as “GDPR”) that your data will be used in the following ways and for the following purposes:

  1. Object of the treatment

Identification personal data provided by the user (as name and surname, telephone number, e-mail address – hereinafter referred to as “personal data” or also “data”) will be treated by the Owner.

Your personal data will be used:

Your personal data are treated as per operations mentioned in article 4 n. 2) GDPR namely: gathering, registration, organization, preservation, consulting, processing, modification, selection, extraction, comparison, use, interconnection, block, communication, deleting and destroying data. Your personal data will be treated both by paper and electronic and/or automatized ways.

The Owner will treat the personal data for the time needed to fulfil the purposes above and, in any case, not over 10 years from the end of the relationship for Service Purposes and not over 2 years from the data collection for Marketing Purposes.

  1. Data access

Your personal data would be available, as per purposes in point C, to the employee and Owner’s partners, as appointed and/or internal responsible of the treatment and/or data controller.

  1. Data communication

No data from the web service (as navigation data mentioned above and cookies) will be communicated nor disclosed (except for the communication, if necessary, to judicial authorities and the police).

Without the necessity of an express consent, see art 6 lett. b) and c) GDPR, the Owner can communicate your data for the purposes in point B.1 to supervisory bodies, judiciary authorities, insurance companies for insurance services, as well as all the subjects to whom the communication is mandatory by law to accomplish the mentioned purposes. These subjects will treat the data as independent owner of the treatment.

  1. Data transfer

Your personal data are stored in the server located in Via Divisione Tridentina, 23, 24020 Villa di Serio (BG), in the European Union. It is understood however that the Owner, if necessary, will have the right to move the server extra-UE. In this case, the Owner guarantees from now that the data transfer to extra-EU will happen in accordance to legal provisions applicable, prior pledging contractual standard clauses, established by the European Union.

  1. Nature of underwriting and refusal consequences

It is mandatory to underwrite data for the purposes as point B.1. In their absence we will not be able to guarantee the services in point B.1

On the contrary, the underwriting of data for the purposes as on point B.2 (marketing purposes) is optional. You can therefore decide not to give any data or stop, also later, the treatment of data previously given: doing so, you will not receive any newsletter, commercial communications and advertising regarding the services offered by the Owner. The rights from services as per point B.1 will persist.

  

  1. Right to access personal data and other rights

As data subject, you have access to the rights as per art. 15-21 GDPR, that is right of access, of rectification, of erasure (“oblivion”), of restriction of processing, of data portability, to object, as well as the right to complaint with the competition authority.

More specifically the right:

 

It is noted that the right to object by the data subject for marketing purposes by automated system is extended to the traditional ones and that the right to object remains even only partially. The data subject can therefore decide to receive communication only by traditional system, meaning automated communication or neither of the two kinds of communication.

  

  1. Procedure for the exercise of the right

You will be able to exercise the right at any moment, sending:

  1. Complaint proposition

The data subject has the right to lodge a complaint to the local State control authorities.

  1. Automated decision-making processes

Automated decision-making processes are not used by the Owner.

  1. Owner, responsible and appointee

The Owner of the treatment is placed in OMCN S.p.A in Via Divisione Tridentina, 23, 24020 Villa di Serio (BG), Italy.

The updated list of responsible and appointee of the treatment is kept at the operational offices of treatment’s Owner.
