{"id":1732,"date":"2015-01-16T18:34:01","date_gmt":"2015-01-16T17:34:01","guid":{"rendered":"http:\/\/www.omcn.it\/?page_id=1732"},"modified":"2018-07-30T15:11:42","modified_gmt":"2018-07-30T13:11:42","slug":"privacy","status":"publish","type":"page","link":"https:\/\/www.omcn.it\/en\/privacy\/","title":{"rendered":"Privacy"},"content":{"rendered":"<p><strong>PRIVACY POLICY<\/strong><\/p>\n<p><strong>(in accordance with UE 2016\/679 regulation)<\/strong><\/p>\n<p>This page describes the website managing procedures referred to users\u2019 personal data treatment.<\/p>\n<p><strong>OMCN S.p.A.<\/strong>, whose registered office is in Via Divisione Tridentina, 23, 24020 Villa di Serio (BG), Italia; P.IVA 01905830160 (hereinafter referred to as \u201cOwner\u201d), as treatment administrator, informs you, in accordance with UE n. 2016\/679 regulation (hereinafter referred to as \u201cGDPR\u201d) that your data will be used in the following ways and for the following purposes:<\/p>\n<ol>\n<li><strong><em> Object of the treatment <\/em><\/strong><\/li>\n<\/ol>\n<p>Identification personal data provided by the user (as name and surname, telephone number, e-mail address \u2013 hereinafter referred to as \u201cpersonal data\u201d or also \u201cdata\u201d) will be treated by the Owner.<\/p>\n<ol>\n<li><strong><em> Treatment purposes <\/em><\/strong><\/li>\n<\/ol>\n<p>Your personal data will be used:<\/p>\n<ul>\n<li><strong>Without Your express consent, <\/strong>as stated in art.6 lett. b), e) GDPR, for the following Service Purposes:<\/li>\n<li>Closing contracts for Owner\u2019s services;<\/li>\n<li>Fulfill pre-contractual, contractual and tax obligation arising from existing contractual relation;<\/li>\n<li>Fulfill the obligation established by law, by a regulation, by community legislation or by an order of the Authority (as in anti-money-laundering);<\/li>\n<li>Exercise the rights of the Owner, for example the right to defense in court;<\/li>\n<li>Only <strong>prior <\/strong>Your specific and clear <strong>consent<\/strong> (art. 7 GDPR), for the following Marketing Purposes:<\/li>\n<li>Send You by e-mail, mail and\/or text messages and\/or telephone contacts, newsletter, commercial communication and\/or advertising materials on products and service offered by the Owner and detect the degree of satisfaction on services\u2019 quality.<\/li>\n<li>Send You by e-mail, mail and\/or text messages and\/or telephone contacts, commercial communication and\/or advertising by third parties<\/li>\n<\/ul>\n<ol>\n<li><strong><em> Treatment procedures <\/em><\/strong><\/li>\n<\/ol>\n<p>Your personal data are treated as per operations mentioned in article 4 n. 2) GDPR namely: gathering, registration, organization, preservation, consulting, processing, modification, selection, extraction, comparison, use, interconnection, block, communication, deleting and destroying data. Your personal data will be treated both by paper and electronic and\/or automatized ways.<\/p>\n<p>The Owner will treat the personal data for the time needed to fulfil the purposes above and, in any case, not over 10 years from the end of the relationship for Service Purposes and not over 2 years from the data collection for Marketing Purposes.<\/p>\n<ol>\n<li><strong><em> Data access<\/em><\/strong><\/li>\n<\/ol>\n<p>Your personal data would be available, as per purposes in point C, to the employee and Owner\u2019s partners, as appointed and\/or internal responsible of the treatment and\/or data controller.<\/p>\n<ol>\n<li><strong><em> Data communication <\/em><\/strong><\/li>\n<\/ol>\n<p>No data from the web service (as navigation data mentioned above and cookies) will be communicated nor disclosed (except for the communication, if necessary, to judicial authorities and the police).<\/p>\n<p>Without the necessity of an express consent, see art 6 lett. b) and c) GDPR, the Owner can communicate your data for the purposes in point B.1 to supervisory bodies, judiciary authorities, insurance companies for insurance services, as well as all the subjects to whom the communication is mandatory by law to accomplish the mentioned purposes. These subjects will treat the data as independent owner of the treatment.<\/p>\n<ol>\n<li><strong><em> Data transfer <\/em><\/strong><\/li>\n<\/ol>\n<p>Your personal data are stored in the server located in Via Divisione Tridentina, 23, 24020 Villa di Serio (BG), in the European Union. It is understood however that the Owner, if necessary, will have the right to move the server extra-UE. In this case, the Owner guarantees from now that the data transfer to extra-EU will happen in accordance to legal provisions applicable, prior pledging contractual standard clauses, established by the European Union.<\/p>\n<ol>\n<li><strong><em> Nature of underwriting and refusal consequences <\/em><\/strong><\/li>\n<\/ol>\n<p>It is mandatory to underwrite data for the purposes as point B.1. In their absence we will not be able to guarantee the services in point B.1<\/p>\n<p>On the contrary, the underwriting of data for the purposes as on point B.2 (marketing purposes) is optional. You can therefore decide not to give any data or stop, also later, the treatment of data previously given: doing so, you will not receive any newsletter, commercial communications and advertising regarding the services offered by the Owner. The rights from services as per point B.1 will persist.<\/p>\n<p><strong><em>\u00a0<\/em><\/strong><strong><em>\u00a0<\/em><\/strong><\/p>\n<ol>\n<li><strong><em> Right to access personal data and other rights <\/em><\/strong><\/li>\n<\/ol>\n<p>As data subject, you have access to the rights as per art. 15-21 GDPR, that is right of access, of rectification, of erasure (\u201coblivion\u201d), of restriction of processing, of data portability, to object, as well as the right to complaint with the competition authority.<\/p>\n<p>More specifically the right:<\/p>\n<ul>\n<li>To obtain the confirmation of the of the existence, or lack of it, of personal data of your concern, even if not yet registered, and their communication under intelligible form.<\/li>\n<li>To obtain indication:<\/li>\n<li>About the origin of personal data<\/li>\n<li>About purposes and methods of treatment<\/li>\n<li>About logic applied when the data is processed with the use of electronic equipment;<\/li>\n<li>About identification details of the Owner, of the responsible and of the designated representative pursuant to art. 3, comma 1, GDPR<\/li>\n<li>About people or categories of people to whom personal data may be communicated or may become aware of as designated representative of the State, as responsible or appointee.<\/li>\n<li>To obtain:<\/li>\n<li>The update, the correction meaning, when you have interest, the integration of data;<\/li>\n<li>The cancellation, transformation into anonymous form or arrest of the personal data processed in contravention of the law. Included data whose retention is not necessary for the purposes they have been collected for or treated afterwards.<\/li>\n<li>The declaration that the people to whom the data have been disclosed, are aware of the operation realised and of their content.
